By using this site, you accept and agree to be legally bound by our terms & conditions, privacy policy and disclaimer.

Terms and conditions may change at any time without notice. Please check them at your next visit so you are aware of the changes.

Your continued use of Suzanne Joy Photography's website means that you agree to be legally bound by the terms & conditions and privacy policy.

In addition to oral and written agreements, use of any images by you as the Client will constitute acceptance of all the below terms and conditions.

GIFT CERTIFICATES

Gift certificates include our standard session fee and specified credit (if any) towards your order.
$100 refundable deposit may be required to secure your time and date and to avoid no-shows.
Cannot be used for those who already have a session booked with Suzanne Joy Photography.
Cannot be used in conjunction with any other gift voucher/certificate, promotion, discount or special offer.
Cannot be used for book projects or calendar contests or other special projects.
Gift certificates may only be used for the exact items outlined on the certificate and not transferred to, or combined with any other package or promotion. Gift certificates are not redeemable for cash.
Gift certificates do not include, prints, products or digital files unless otherwise stated.
Should a gift certificate recipient wish to purchase additional prints/artwork over the value of their gift certificate, these will be charged according to our pricing. Product orders must be made at the scheduled ordering appointment.
The photography session is to be held at an agreed time and location. In the event you need to reschedule and cannot give more than seven days notice, a rescheduling fee of $99 is required.
Pet photography session gift certificates are valid within 30kms of Brisbane CBD, otherwise the following $1 per km non-refundable travel fee applies.
Gift certificates are non-refundable and not redeemable for cash.
Gift certificate is valid for one photographic session only for up to two pets from the same household. An additional fee of $55 per additional pet applies. Only one gift certificate can be used per household.
Gift certificates are valid for one years from the date of purchase unless otherwise stated. Gift certificates from promotions, contests or competition or purchased on a special or lower price may have a shorter validity date.
If you decide not to use the gift certificate yourself, you may pass it on to a friend or family. Terms & conditions of sale and usage will also be transferred.
Gift certificates must be registered before use and used by the expiry date on the card.
As a gift certificate holder, no upfront booking fees are required, however cancellation policies for photography sessions and ordering appointments applies, and non-compliance can result in loss of gift certificate value.

GIVEAWAY AND COMPETITION TERMS AND CONDITIONS

Any offers or specials cannot be used in conjunction with any other offer or gift certificates. Gift certificates and artwork/print credits are not transferable or redeemable for cash.
Clients who have previously been offered a complimentary photography session through a promotion, competition or gift certificate, and have taken their free print or not purchased any artwork, are ineligible for future giveaways, competitions, prizes, model calls, or further complimentary sessions or special offers. If you wish to book again or participate in a special offer or project, you may pay the standard session fee or pre-purchase artwork.
Existing clients can enter but priorities will be given to new / prospective clients.
Our booking documents (contract and questionnaire) are required to be completed for all bookings therefore only those above the age of 18 years are eligible to enter our giveaways, competitions, and model call outs.
Giveaways and competitions are only redeemable in Brisbane, Gold Coast regions. Suzanne Joy Photography refuses the right to travel outside these locations.
Giveaways and competitions involving collaborations with other businesses will required Suzanne Joy Photography to share your contact details with the participating businesses. In submitting your entry form you understand and accept this terms and conditions.
DEPOSIT: A $100 booking deposit will be payable to secure your photography session time for any complimentary session. This fee will be applied as print credit for prints and products ordered at the ordering appointment. If client does not show up for session and/or ordering appointment, does not complete contract and questionnaire prior to their session or fail to cancel within 5 business days, booking deposit will not be refunded.

GENERAL TERMS AND CONDITIONS

COPYRIGHT:

You, as the client, acknowledge that Suzanne Joy Photography is the first and sole owner of all copyrights of the image(s). All Images and copyrights remain the exclusive property of Suzanne Smith of Suzanne Joy Photography without limitation. Any images posted on social media pages may be shared by you but images are not to be printed or the watermark removed and must be credited to Suzanne Joy Photography in all instances.
Images may be used by us for marketing, competitions, stock, publishing or any other purpose we may require them for.
Images are licensed for personal use only and not to be sold or used for commercial purposes. Images produced by Suzanne Joy Photography may not be used for commercial purposes or on-sold to a third party by anyone other than us.
You, as the client, understand and agree that you are not buying the images but is paying only for a license to use the image(s). The term of license begins from the date Photographer receives full payment of invoice.
Copyright metadata contained within any digital file may not be altered, or removed, without the express consent of Photographer.
You agree to the images produced at your session being posted online on Suzanne Joy Photography's website as well as by other industry related websites/blogs and social media sites like Facebook and Instagram.

Image Use and Model Release:

I hereby give Suzanne Smith and Suzanne Joy Photography and Assigns my permission to license the Images and to use the Images in any Media for any purpose (except pornographic or defamatory) which may include, among others, advertising, promotion, competition, image awards, marketing and packaging for any product or service and use, or for display within or on the Photographer’s website and/or studio. You also relinquish any right to examine or approve the completed product or advertising copy or printed matter which may be used. All rights to the Images belong to the Photographer and Assigns. I acknowledge and agree that I have no further right to additional Consideration or accounting, and that I will make no further claim for any reason to Photographer and/or Assigns. I acknowledge and agree that this release is binding upon my heirs and assigns. I agree that this release is irrevocable, worldwide and perpetual. Copyright metadata contained within any digital file may not be altered, or removed, without the express consent of Photographer.

Property Release:

“PROPERTY” means the pet or property that is the subject of the Shoot. As owner or authorized representative of the Property and by signing this release, I give the Photographer and Assigns my permission to create and use the Images depicting the Property in any Media, for any purpose (excluding defama- tion and/or pornography) which may include, among others, advertising, promotion, marketing, promotion, competition, image awards, and packaging for any product or service or for display within or on the Photographer’s website and/or studio. I agree that the Images may be combined with other images, text and graphics and cropped, altered or modified. I agree that all rights to the Images belong to the Photographer and/or Assigns. I agree that I have received Consideration for the rights granted in this release. I acknowledge and agree that I have no further right to additional Consideration or accounting, and that I will make no further claim for any reason to Photographer and/or Assigns. I acknowledge and agree that this release is binding upon my heirs if applicable, assigns or any person claiming an interest in the Property. I agree that this release is irrevocable, worldwide and perpetual, and will be governed by the laws.

THE PHOTOGRAPHY SESSION:

Before any shoot takes place, a release form must be signed that stipulates that the copyright of the images taken during our shoot by our photographers belongs to us according to the Australian Copyright Act 1968.
Additional travel costs are at the discretion of the photographer based on location and travel distance and will be advised prior should these apply.
Any images from the session are purchased additionally, charged at Suzanne Joy Photography's standard portrait product pricing. The client will be advised of price ranges and invited to an in person ordering appointment to view the final selection of images and make any purchases of photographic products at that time.
You are not permitted to alter any of the images received from the Photographer. Prior approval must be sought in writing prior to any submission of images to a third party, publication or competition. Credit must be given to Suzanne Joy Photography when posting images online and on social media.

PHOTOGRAPHIC INTEGRITY and ALTERATIONS:

You, as the client, will not make or permit any alterations, including, but not limited to, additions, subtractions, or adaptations, with respect of the Image(s), alone or with any other material, without the prior express permission of Suzanne Joy Photography. Normal reproduction adjustments for colour, contrast, brightness, sharpness, and cropping, are permitted.

GENERAL LIABILITY and RELEASES:

You, as the client, will indemnify, defend, and hold harmless, Suzanne Joy Photography and their assigns, contractors, and representatives, against any and all claims, liabilities, damages, costs, and expenses, including reasonable legal fees and expenses, arising from your use of the Image(s).

Unless delivered to you by Suzanne Joy Photography, no model, property, trademark, or other, releases exist for any Image(s). It is your responsibility to obtain the necessary permissions for uses that require any release not delivered by Suzanne Joy Photography.

It is your responsibility to determine whether any releases delivered by Suzanne Joy Photography are suitable for your purposes.

In any event, Suzanne Joy Photography's liability for all claims will not exceed the total amount paid under this Agreement.

WEBSITE TERMS AND CONDITIONS

INTRODUCTION:

(a) These terms and conditions (Terms) apply when you use this website, https://www.suzannejoyphotography.com/(Website).

(b) You agree to be bound by these Terms which form a binding contractual agreement between you and us, Suzanne Smith trading as Suzanne Joy Photography.

(d) We may change these Terms at any time by updating this page of the Website, and your continued use of the Website following such an update will represent an agreement by you to be bound by the Terms as amended.

LICENCE:

(a) You grant to Suzanne Joy Photography a perpetual, irrevocable, transferable, worldwide and royalty-free licence (including the right to sublicense) to use, copy, modify, reproduce and adapt any Intellectual Property Rights in any Posted Material in order for Suzanne J Photography to use, exploit or otherwise enjoy the benefit of such Posted Material.

(b) If it is determined that you retain moral rights (including rights of attribution or integrity) in any Posted Material, you forever release Suzanne Joy Photography from any and all claims that you could assert against Suzanne Joy Photography by virtue of any such moral rights.

(c)You indemnify Suzanne Joy Photography against all damages, losses, costs and expenses incurred by Suzanne Joy Photography arising out of any third party claim that your Posted Material infringes any third party’s Intellectual Property Rights.

SECURITY

We do not accept responsibility for loss or damage to computer systems, mobile phones or other electronic devices arising in connection with use of the Website. You should take your own precautions to ensure that the process that you employ for accessing the Website does not expose you to risk of viruses, malicious computer code or other forms of interference.

REPORTING MISUSE

If you become aware of misuse of the Website by any person, any errors in the material on the Website or any difficulty in accessing or using the Website, please contact us immediately using the contact details or form provided on our Website.
